Terms and Conditions

Welcome to NextKeys Auto Group LLC. These Terms and Conditions govern your access to and use of our website, online booking tools, payment links, vehicle listings, rental services, Rent to Own programs, vehicle sales, vehicle sourcing, delivery services, concierge services, and related business services.

By accessing this website, submitting a reservation request, signing an agreement, making a payment, or using any NextKeys Auto Group service, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

1. Services

• Short term and weekly vehicle rentals
• Seven day minimum rental programs
• Rideshare ready vehicle rentals
• Rent to Own vehicle programs
• Vehicle sales and sourcing
• Vehicle delivery and concierge services
• Fleet management and related support services
• Optional rental add ons

All services, vehicles, pricing, qualifications, and availability are subject to change.

2. Eligibility and Customer Requirements

• Customers must generally be at least 25 years old
• A valid driver’s license is required
• Accurate identity, contact, and payment information must be provided
• A valid payment method is required
• All rental, insurance, purchase, and program requirements must be met
• All required agreements must be signed before vehicle possession

3. Reservations and Vehicle Availability

A reservation is not final until all required payments, documents, identity checks, and signed agreements have been completed and NextKeys Auto Group has issued confirmation.

Vehicle availability may change because of maintenance, repairs, accidents, customer extensions, late returns, recalls, weather, transportation delays, or circumstances beyond our control.

If a reserved vehicle becomes unavailable, NextKeys Auto Group may offer a substitute vehicle, reschedule the reservation, provide account credit, or issue a refund when required.

4. Pricing, Taxes and Fees

All prices are subject to applicable taxes, fees, deposits, optional services, and charges unless expressly stated as an all inclusive total.

Additional charges may include:

• Administrative and Processing Fee
• Booking and Support Fee
• Florida rental car surcharge
• Environmental Fee
• Roadside Assistance Fee
• Electronic Payment Processing Fee
• State and local taxes
• Security deposit or airport rental deposit
• Delivery or concierge fee
• Fuel charges
• Toll charges
• Late fees
• Cleaning fees
• Smoking fees
• Damage charges
• Recovery, towing, impound, or repossession charges
• Optional add ons or upgraded services

By completing a reservation or submitting payment, you acknowledge and agree to all applicable rental charges, taxes, the 3% electronic payment fee, the 7% state and local tax, deposits, optional charges, and additional fees listed on your invoice, booking page, receipt, signed agreement, or these Terms and Conditions.

5. Payments and Payment Authorization

Payments must be made using an approved payment method and according to the due dates stated in the customer’s invoice or agreement.

By submitting payment, the customer authorizes NextKeys Auto Group and its payment processors to process applicable charges, including:

• Rental charges
• Taxes and fees
• Deposits and extensions
• Late fees
• Tolls, citations, parking charges, and related administrative costs
• Fuel, cleaning, smoking, damage, towing, recovery, and impound charges
• Amounts due under any signed agreement

Chargebacks, returned payments, reversed payments, or unauthorized payment claims do not cancel an otherwise valid debt or contractual obligation.

6. Rental Agreements

Every rental is governed by a separate written Rental Agreement. If these website Terms conflict with a signed Rental Agreement, the Rental Agreement will control.

Unlimited mileage remains subject to reasonable use, maintenance schedules, oil change requirements, geographic restrictions, prohibited use terms, and other limitations stated in the Rental Agreement. Unlimited mileage does not authorize abusive, negligent, unsafe, unlawful, or excessive use.

7. Rent to Own Programs

Participation in a Rent to Own program is subject to a separate written agreement and approval requirements.

Rental payments do not automatically transfer ownership. Ownership transfers only after all required payments, fees, taxes, insurance obligations, balloon payments, title requirements, and contractual obligations have been completed.

Late payments, partial payments, payment arrangements, contract violations, or vehicle misuse may disqualify a customer from Rent to Own eligibility.

8. Vehicle Sales

All vehicle purchases are governed by a separate written sales contract, buyer’s order, financing document, disclosure, or bill of sale.

Vehicles may be sold as is, without warranty, unless a written warranty is expressly provided.

9. Cancellations, Refunds and Credits

Cancellations, refunds, credits, deposits, reservation fees, unused rental time, early returns, no shows, and rescheduling requests are governed by the posted Refund and Cancellation Policy and the applicable signed agreement.

Unless otherwise required by law or stated in writing, electronic payment fees, booking fees, administrative fees, delivered services, completed services, and incurred costs may be nonrefundable.

10. Vehicle Use and Customer Responsibility

Customers must operate vehicles lawfully, safely, and according to all signed agreements.

• No unauthorized drivers
• No illegal activity
• No driving while impaired
• No smoking or vaping inside the vehicle
• No racing, towing, off road driving, or reckless use
• No disabling equipment
• Accidents, damage, theft, warning lights, and mechanical concerns must be reported immediately

Customers may be financially responsible for damage, deductibles, cleaning, smoking, towing, storage, impound charges, lost keys, unpaid tolls, citations, administrative costs, diminished value, loss of use, and recovery expenses.

11. Website Use

• Do not use the website for fraud or unlawful purposes
• Do not submit false or misleading information
• Do not attempt unauthorized access
• Do not disrupt website operations
• Do not copy or scrape website content without permission
• Do not use another person’s identity or payment information without authorization

12. Intellectual Property

Website content, logos, branding, photographs, graphics, service descriptions, forms, written materials, and designs belong to NextKeys Auto Group LLC or are used with permission.

13. Third Party Services

NextKeys Auto Group may use third party providers for payment processing, online booking, website hosting, identity verification, insurance, roadside assistance, vehicle tracking, communications, analytics, customer management, and electronic signatures.

14. Disclaimer and Limitation of Liability

The website and its content are provided on an as is and as available basis. To the fullest extent permitted by law, NextKeys Auto Group will not be liable for indirect, incidental, special, punitive, or consequential damages arising from website use, inability to access the website, reliance on website content, or third party services.

15. Governing Law

These Terms are governed by the laws of the State of Florida. Any dispute will be handled in a court of competent jurisdiction in Florida unless a signed agreement provides otherwise.

NextKeys Auto Group LLC respects your privacy. This Privacy Policy explains what information we collect, how we use it, how it may be shared, and the choices available to you.

• Reservation, rental, vehicle, and purchase information

3. Payment Information

Payments may be processed by third party payment providers. NextKeys Auto Group does not generally store full credit or debit card numbers on its own website servers.

4. Email and Text Message Communications

By providing your email address or phone number, you consent to receive communications related to reservations, agreements, payment reminders, invoices, vehicle updates, appointments, customer support, account activity, and legally required notices.

Marketing messages will be sent only as permitted by law. Message and data rates may apply. You may reply STOP to supported text messages to opt out of nonessential text communications. Opting out does not prevent messages necessary to complete an active transaction, enforce an agreement, protect a vehicle, or comply with law.

5. Cookies and Website Technology

Our website may use cookies, analytics, pixels, and similar technologies to remember preferences, measure traffic, improve performance, prevent fraud, and understand website use.

6. How We Share Information

We do not sell personal information for money. Information may be shared with:

• Payment processors
• Insurance and roadside assistance providers
• Identity verification and fraud prevention providers
• Website, booking, CRM, communications, and electronic signature providers
• Vehicle tracking, telematics, towing, recovery, repossession, and fleet service providers
• Accountants, attorneys, insurers, contractors, and other professional service providers
